APPLICATION & DEFINITIONS

1.1This Agreement applies to all tours, excursions, transport, accommodation, water-based activities, land-based activities, recreational, cultural, religious, adventure and sporting activities conducted domestically or overseas by Revival Tours.
1.2“Activities” includes snorkeling, swimming, boating, hiking, trekking, cliff jumping, marine exploration, off-road transport and all associated risks.
1.3“Claim” includes any action, proceeding, demand, liability, loss, damage, expense or cost (including legal costs on an indemnity basis).

2.1You acknowledge that certain Activities may constitute high-risk activities.
2.2These may include open water swimming, strong currents, remote hiking, boat transfers, uneven terrain and exposure to wildlife.
2.3You acknowledge participation may result in serious injury, permanent disability or death and voluntarily assume all such risks.

3.1Activities conducted overseas may involve differing safety standards, limited regulatory oversight and reduced access to emergency services.
3.2You acknowledge Australian safety standards may not apply overseas.
3.3You assume all risks associated with international travel and foreign jurisdictions.

4.1You warrant you are medically fit to participate.
4.2You authorise emergency medical treatment and evacuation if required.
4.3You accept full responsibility for all medical, evacuation and repatriation costs.

5.1Comprehensive travel insurance including water and adventure activity coverage is strongly recommended.
5.2Revival Tours is not liable for medical costs, cancellations, evacuation, theft or lost property.

6.1To the maximum extent permitted by law, Revival Tours, its directors, employees and agents are not liable for personal injury, death, property loss or consequential loss.
6.2Where liability cannot be excluded under the Australian Consumer Law, liability is limited to re-supply of Services or payment of re-supply cost.

7.1In consideration of participation, you irrevocably release and discharge Revival Tours from all Claims arising directly or indirectly from participation.
7.2You covenant not to sue Revival Tours in any jurisdiction.
7.3You indemnify and hold harmless Revival Tours from and against any Claims, including third-party Claims, arising from your conduct or participation.
7.4This clause survives termination and completion of Services.

8.1You grant Revival Tours a perpetual, worldwide, royalty-free licence to use photographs, video or media captured during the tour for promotional purposes.
8.2You waive any right to compensation for such use.
8.3If you do not consent, you must notify Revival Tours in writing prior to departure.

10.1If the participant is under 18, a parent or guardian must accept this Agreement.
10.2The guardian accepts all risks and indemnifies Revival Tours on behalf of the minor.

11.1Revival Tours is not liable for events beyond reasonable control including natural disasters, pandemics, political instability or airline failures.

14.1By ticking the booking checkbox, you confirm you have read, understood and agree to this Agreement.
14.2Electronic acceptance constitutes legally binding consent.
